Acceptance of Terms & Conditions:
By making your reservation, payment and using our service, you are confirming that you have read, understood, accept and agreed to the Terms and Conditions contained herein and expressly releases My Vacation Escape Services from any and all liability.
Reservation
The Party Leader (Person in whose name the booking is made) will be responsible for the full cost of the accommodation and other services contracted. To avoid confusion, we will only deal with/communicate with the Party Leader, who must be an adult, over 18 years old.
The Party Leader is accepting this Agreement on behalf of everyone who will be staying at the accommodation. The Party Leader is also confirming that each member of the party/group accepts these Terms and Conditions.
A Booking Confirmation is issued upon receipt of payment for your booking. Please make sure to check your Confirmation carefully to ensure that you have been confirmed for what you intended to book.
Check in/Check out
Check in time is between 2:00 PM and 3:00 PM. Check Out time is 11:00 AM
Payments
A 20% deposit is required to confirm your booking, with the balance due no later than 30 days prior to the start of the booking period. If your reservation is less than 30 days to the start of the booking period, full payment is required. Payments can be made via credit card (Visa or Mastercard), Wire Transfer, or Direct Deposit. We do not store credit card details.
We and the Accommodation Owner reserve the right to cancel your booking and return your payments in full in our absolute discretion.
The Price You Pay & Guarantee
Mistakes do happen from time to time. If any price on your booking confirmation, our website or booking systems is obviously wrong, a booking made on that price will not be valid. We can cancel it and make a refund, unless you want to pay the correct price and proceed with the booking.
Rates are subject to change without prior notice. However, the price you paid at the time of booking is guaranteed. If any new Government Tax or Levy is imposed, we reserve the right to pass these costs on to you. If you do not wish to pay same, you may cancel your booking for a full refund.
Refunds
Please note that cancellation of your booking may result in forfeiture of your payments. There is no refund under any circumstances for any unused portion of booked accommodations. We therefore highly recommend that you obtain travel insurance, including trip cancellation insurance to protect you from unforeseen events.
- Cancellation of reservations in the Low Season (April 16 – December 14)
(a). Sixty (60) or more days prior to the arrival, a cancellation fee of 80% of the amount paid, plus US$100 administrative fee will be charged.
(b). Less than sixty (60) days prior to the arrival date, all funds will forfeited.
2. Cancellation of reservations in the High Season (December 15 – April 15), or any holiday weeks (Easter, Thanksgiving, Christmas, New Year).
(a). More than one hundred and twenty(120) days prior to the arrival date, a cancellation fee of 90% plus US$100 administrative fee of the amount paid will be charged.
(b). Less than one hundred and twenty (120) days prior to the arrival date, all funds paid will be forfeited.
There is no refund under any circumstances for any unused portion of booked accommodation(s), late arrivals, early departures or no-shows.
Travel Insurance
We highly recommend that you obtain travel insurance, including trip cancellation insurance.
Satellite, Cable, Telephone & Utilities
There may be interruptions or malfunction in the supply of public utilities to the accommodation. There is no refund or compensation of any kind for the failure, interruptions or malfunction of satellite/cable, telephone TV systems, electricity and other utilities provided in the accommodation. We do not accept any responsibility of same, as the provision of these services are beyond our control.
Building Work & Nuisance
From time to time, there might be building work and associated noises that are unavoidably close to your accommodation. This unfortunately is not under our control and we therefore accept no responsibility for same.
Maintenance and Repairs
We will do our best to ensure that any necessary repairs and maintenance work are carried out as quickly as possible after we are notified, in order to minimize any inconvenience to you.
What IS Included
Rates are inclusive of all Jamaican taxes, staff salaries, laundry, utilities (water and electricity) cleaning, and some household supplies. Your accommodation is equipped with linen, bath and beach towels, dishes, utensils, soap and toilet tissue. One courtesy round-trip transportation to and from the Montego Bay airport is provided to guests booked for 7 or more nights with all guests arriving and departing together.
What is NOT Included
Rates are not inclusive of any insurance, flights, airport charges, car rentals, baggage handling, staff gratuities, telephone charges, food, beverages, liquor, personal items and expenses, dry cleaning, or babysitting. If startup groceries is required, we request that you notify us at least 2 days prior to your arrival.
Maximum Number of Persons Allowed
The rates for the villas and cottages are based on a maximum of two persons sharing a bedroom. So for example, a four bedroom rental will accommodate up to 8 persons. Children, less than 2 years old at the time of the occupation of the villa/cottage, may share an adult’s bedroom at no extra charge. Should you exceed the maximum allowed under these terms and conditions, the EXTRA persons are NOT permitted to take up occupancy UNLESS prior permission is obtained in writing and reflected on your Printed Confirmation. The surcharge for each extra person is between US$40 to US$60 per night, depending on the villa/cottage.
Persons Permitted at the Accommodation
The person making this reservation is entitled to accommodation for the number of persons that is stated on the Reservation Form and no more. Only you and members of your party are permitted to use the accommodation. No other persons are permitted to enter Silver Sands and the Accommodation, except for the Accommodation’s staff and our representatives (each a “Permitted Person”), without our prior permission in writing.
We ask that you do not to invite any sellers, vendors, and others into the accommodation. Should you invite any person other than a Permitted Person into the villa/cottage, you do so at your own risk and you will be responsible (and My Vacation Escape Services excludes all liability) for any losses or damages which may result directly or indirectly from your failure to comply with this requirement. Your booking may also be cancelled immediately without any refund, at which time you will be required to leave the villa/cottage. All obligations to you by My Vacation Escape Services will cease immediately.
Termination
You are responsible for the proper conduct of yourself and all members of your party during your stay. Should there be a case of serious misconduct, My Vacation Escape Services reserves the right to terminate your booking and that of any member of your party. If we do so, we shall have no further responsibility or liability to you. If you or any member of your party deliberately or negligently cause any loss or damage to any villa/cottage, person or property, you agree to compensate us for any loss suffered by My Vacation Escape Services, including legal costs, arising from such damage.
Damage Deposit
Some villas require a damage deposit. This will promptly be refunded (after inspection), provided there were no damages to the property during your stay.
Breakage and Damages
Apart from fair wear and tear, you are responsible for the condition of the home and its contents. You will be responsible for the cost of any damage or breakage, caused by you or any member of your party.
Airport Transfers
Transfers to and from Montego Bay Airport (i.e. one pick up and one drop off, for all members of the party traveling together) are included in the Weekly Rates for the villas and cottages. Additional transfers to and from Montego Bay Airport will attract an additional charge. We allow for two suitcases per passenger, and we are under no obligation to transfer any additional suitcases, windsurfers, surfboards, bicycles or other unconventional luggage unless we have consented to do so, in advance.
Transportation Services
We use the services of a group of local drivers, either to or from the airport or to other destinations. These drivers are independent parties who are responsible for their own licenses, insurance, and vehicles’ roadworthiness. When making these arrangements on your behalf, we are acting solely as your agent and you accept the transportation service at your own risk.
You book all your transportation needs with us, prior to your arrival or during your stay. We recommend that bookings be made as early as possible, to guarantee availability. The advice given on journey times is done in good faith and cannot be guaranteed that any journey will be completed in the specified time. You are required to pay the costs of the transportation to us in advance of your journey. In the event that you subsequently make any variations to your journey, we reserve the right to alter the costs appropriately.
You may cancel any order for transportation up to 24 hours to obtain a full refund; if you fail to do so then you will remain liable for the full cost. We reserve the right to terminate any transport services in the event of a riot, civil unrest, war, extreme weather conditions or any other events that in our opinion are likely to be a threat to your safety, if we do this we will refund to you the cost of the service.
Drivers reserve the right to refuse to transport passengers where to do so would exceed the vehicle’s capacity or if they deem them to be intoxicated or abusive and no refunds will be given in these cases. In the event that a driver fails to arrive, we will use our reasonable endeavors to arrange a suitable alternative and if this is not possible, we will refund you the cost of the transportation and this will be our total liability to you.
Parents or guardians are responsible for ensuring that their children are appropriately strapped in and we accept no liability whatsoever resulting from any failures to do so. If requested at the time of booking, we can arrange for child seats to be provided at an additional cost of US$20, however, we cannot guarantee immediate availability at all times. If services are canceled due to a lack of appropriate child restraints we will refund the transportation costs.
Liability
My Vacation Escape Services is in no way responsible for any damage, loss, harm, delay or experience caused by acts of God, acts of terrorism, labor unrest, theft, monetary crisis, inclement weather, quarantine restrictions, arrest or restraint by any government, hazards of war, civil commotion, or any situations/conditions outside of its control.
The accommodation providers, transportation carriers and other suppliers providing travel, accommodation or other services are independent contractors and are not agents or employees of My Vacation Escape Services.
My Vacation Escape Services is therefore not responsible in any way for injury, damages (property or otherwise), expense, loss or death arising in connection with the provision of any service we offer or the rental of ground transportation, the action or omission of any travel agency or tour operators, accommodation, arising in connection with the provision of any service or the rental of any accommodation or attraction, affiliated with any airline, vessel or ground carrier. The limit of My Vacation Escape Services’ liability is the full price paid to said company.
